These Terms & Conditions ("Terms") are a set of legally binding terms defined by AquaTerra Tours (hereinafter "AquaTerra Tours," "we," "us," or "our") and govern the relationship between us and you, the client (hereinafter "you" or "participant"), concerning the booking and participation in any tour, activity, or service ("Tour") offered by AquaTerra Tours. 2. Booking & Confirmation

2.1. Booking Request: All Tour bookings are subject to availability. A booking request can be made via our website, email, or phone. 2.2. Confirmation: Your booking is confirmed only upon receipt of a written confirmation from AquaTerra Tours and payment of the required deposit or full amount, as specified in your booking details. 2.3. Accuracy of Information: You are responsible for providing accurate and complete information during the booking process. AquaTerra Tours is not liable for any issues arising from inaccurate or incomplete information provided by you.

3. Payments

4. Cancellations & Refunds

We are not responsible for any incidental expenses you may have incurred (e.g., flights, accommodation, visa fees). * We will make every effort to notify you of any cancellation as soon as possible.

5. Changes by AquaTerra Tours

5.1. Minor Changes: AquaTerra Tours reserves the right to make minor changes to the itinerary, accommodation, or guides if necessary due to operational reasons, local conditions, or unforeseen circumstances. We will endeavor to maintain the overall quality and nature of the Tour.

 

5.2. Significant Changes: If a significant change (e.g., change of Tour date, major alteration to the itinerary) becomes necessary, we will inform you as soon as possible and offer you the choice to accept the change, book an alternative Tour, or receive a full refund.

6. Participant Responsibilities & Conduct

6.1. Eligibility & Health: You must inform AquaTerra Tours of any medical conditions, allergies, or physical limitations that may affect your ability to participate in the Tour. You are responsible for ensuring you are physically capable of undertaking the chosen Tour.

 

6.2. Adherence to Instructions: You must follow the instructions and advice of your AquaTerra Tours guide at all times, particularly regarding safety, environmental practices, and wildlife observation etiquette.

 

6.3. Respect for Nature & Local Communities: You agree to adhere to eco-friendly practices, respect the natural environment, its flora and fauna, and local communities. This includes staying on marked trails, not disturbing wildlife, and disposing of waste properly.

 

6.4. Personal Belongings: You are responsible for your personal belongings and equipment. AquaTerra Tours is not liable for any loss, damage, or theft of personal property during the Tour.

 

6.5. Right to Refuse/Terminate Participation: AquaTerra Tours reserves the right to refuse participation or to terminate a participant's involvement in a Tour at any time if, in the reasonable opinion of our guide, the participant's conduct is disruptive, unsafe, or in violation of these Terms, without any right to a refund.

7. Health & Safety

7.1. Safety First: Your safety is our paramount concern. Our guides are trained in first aid and rescue education.

 

7.2. Risk Acceptance: While we take all reasonable precautions, participation in nature tours inherently involves some degree of risk. By booking, you acknowledge and accept these risks.

 

7.3. Emergencies: In case of an emergency, our guides are equipped to provide initial assistance and contact local emergency services.

8. Insurance

​

8.1. Mandatory Travel Insurance: It is a mandatory condition of booking that all participants have adequate travel insurance covering personal accident, medical expenses, emergency repatriation, and cancellation. We strongly recommend that your insurance also covers personal liability, loss of luggage, and curtailment.

 

8.2. Proof of Insurance: We may request proof of your insurance policy prior to the Tour start date.

 

 

9. Liability & Warranties

We are not liable for any injury, loss, damage, delay, or inconvenience caused by or resulting from: * Acts of God, force majeure, or other events beyond our reasonable control. * Acts or omissions of third-party service providers (e.g., transport providers, accommodation providers) not directly under our control. * Your own negligence or failure to comply with these Terms or the instructions of our guides. 9.2. Our liability for any loss or damage suffered by you is limited to the total Tour price paid by you. 9.3.
